I'm not sure how an officer who wants to take your kids away has a conflict of interest with putting one of the children's caretakers in jail. that would make his job a lot easier.Do you assume that DFS is concerned with your wellfare or the wellfare of your children? and Do you think that they must abide by some rule that would call getting your husband out of the way so they can take your kids away a "conflict of interest"? They do not have your best interest at heart. They are aware of how terrible the foster system is, they still throw children in it every day, many ripped from the arms of loving but troubled parents.If you can afford one you should contact a lawyer as soon as possible. If you can not afford a lawyer go to google and type "legal aid [your city name]" and reach out to them. Listen to how THEY tell you the system works. I'm not sure what you believe, but i am sure that some percentage of it is wrong, based on how you just described this situation.Your Husband should contact the Public Defender's office if he does not have the money to hire his own criminal defense lawyer. Warrants do not go away on their own, if he ignores this warrant long enough they may hold a trial without him. he will almost inevitably be found guilty of all charges. At a minimum the public defender's can negotiate for a better sentence using the leverage of trial. (eg. if you don't make the prosecutors work, they will not send you to jail for as long).
I'm telling you, go to the courthouse, I'd like to think some of these district judges, and magistrate judges (many of whom do not have law degrees, and are just retired cops--you know cops from the time when we couldn't deny the system was racist?) I'd like to think these judges wouldn't be quite so unfair if they had an audience. and furthermore if ANYONE you know has court date, show up with them, Be a witness, be someone a public defender can point towards and say "this is a one off, the defendant has a support system, ready to help them become better, we don't need to put this person in jail, jail doesn't make anyone better." And if the judge isn't listening to a decent argument, tell your friends, all of them, and register to vote, because--again--most folks don't get that far down on the ballot, but that's where change happens on a community level.
If a public defender's office (that has a brain) knew they had a few family members in the public section, they might be able to leverage some police abuse videos for reasonable deals, if it's relevant to the case, it's admissible at some phases of trial--sentencing, and Bail hearings--being a big two.
This is the problem with the “system”, injustice can happen in a matter of minutes, even seconds… however getting Justice takes months/ years, resources and money. This is the big imbalance that greats a system where there are the “haves” and “have nots”.
Discuss Judges and actually vote for judges and District Attorneys. Very often people don't make it that far down on the ballot, but judges are pretty much unaccountable in the courtroom (Read Immune from suit etc.), so they have to be held to account somewhere, and the only place that works is the ballot box. Prosecutors are close to the same level of unaccountability, often because the judges are former prosecutors.
